BOOKING TERMS AND CONDITIONS (for Gym Member)

Please read these booking conditions carefully, they are an important part of your contract for your activity. These conditions of booking and information on this website set out the terms on which you contract with us. They shall be governed by and construed in accordance with English law, being subject to the jurisdiction of the Courts of England and Wales. No variation shall be of any effect unless in writing and by the authority of us.

Simply:

1. Simply:

You pay a non-refundable deposit to secure our services and that also signifies you accept these conditions.

1. You pay a depost

Before you book we will agree the services you require, the time, the place and the cost. Once agreed, you must accept on behalf of all of your party the terms of these conditions of booking and pay a non-refundable deposit (typically about a third of the total cost). The contract is made between us when you pay the deposit. We will send you a confirmation invoice detailing the agreement and how to pay the deposit. This deposit secures our services for the agreed activity. The deposit paid in respect of each activity is accepted as a first instalment of charge. The final balance of payment is typically due 60 days before the final Alpine Adventure takes place.

2. If you change your booking

If after your booking has been confirmed (i.e. after you have paid your deposit) you wish to transfer to a different activity, date or location, we will make every effort to satisfy your requirements provided that (i) your gym/studio has arranged another trip with Mountain Coach and (ii) written notification (email) is received from the person who made the booking, not later than the date on which balance of the original activity price is due for payment (typically 60 days before the final Alpine Adventure). Alterations made within the balance due period will be regarded as a cancellation by you of the original activity. If after your booking has been confirmed, you are unavoidably prevented from proceeding and wish to transfer your confirmed booking to another suitable person, you can do so. You, as transferor of the activity, and the transferee shall be jointly and severally liable to us for the payment of the balance due.

If you cancel, tyou will lose the money you have paid to that point.

3. If you cancel your booking

Should you, or any member of your party, be forced to cancel your booking, you must do so in writing (e-mail is fine). If the cancellation occurs between the period after the deposit has been paid, and within 61 days before the final Alpine Adventure, only the deposit will be lost. If you cancel during the final 60 days before the Alpine Adventure (having paid the outstanding balance), you will unfortunately lose the full amount you have paid. This is because Mountain Coach will have guaranteed payment to accommodation providers, plus it will have already delivered services that include support, UK Mountain Conditioning Days and have incurred other costs.

4. Rights of admission

We reserve the unconditional right to refuse a booking or to debar a person from an activity in the event of conduct which in our reasonable opinion is likely to cause distress, damage or annoyance to guests, employees, property or to any third party. This includes any guest who fails to advise us of a medical condition or of a disability which prevents their full participation in an activity programme. If we are not informed in this way we cannot be held responsible for any inconvenience or costs incurred by you & this may include our refusal to complete your activity arrangements. Cancellation charges of 100% would apply in these circumstances. Smoking is only permitted where it does not cause distress or annoyance to others & will not be permitted if there is a significant fire risk in activity area.

4. Simply:

We expect people to behave respectfully and tell us about all medical conditions. We’d prefer you not to smoke but if you must then please consider others and your surroundings.

5. Accuracy

The information given on this website and in other presentations and materials about dates, times and itineraries has been carefully checked and we believe it is correct at the time of publication. We reserve the right to make changes and where they occur we will tell you as soon as we are aware. Descriptions are provided by us in good faith and every care is taken to ensure accuracy. Between publication and your activity, changes can and do occur. We feel it is right to let you know that advertised facilities may be subject to change by the various suppliers concerned. There may be occasions when an advertised facility is not available during your Adventure. This may be due to insufficient numbers, weather, operational or maintenance reasons.

6. If we alter your activity

Although unlikely, we may need for various reasons, e.g. weather, local conditions, etc. to alter (rather than cancel) an activity. If we have to alter your activity we will, if possible, advise you before departure, but we are not obliged to do so or to pay you compensation. An example of when this might occur is if there was a landslide that made a particular route impossible. In such situations, Mountain Coach, with safety as the priority, would adapt the route to an alternative, but it could mean that a particular summit, col or other anticipated highlight is not achievable.

We’ll try to let you know about any changes beforehand.

7. If we cancel your activity

We’ll do our best to run the Adventure, but if we can’t run it then we’ll give you a refund.

We make every endeavour to operate all of our Adventures. In the extremely unlikely event that we have to cancel your Adventure, a full refund will me made. The only instance where you would not receive a refund is in the event of a Force Majeure. This means unusual and unforeseeable circumstances beyond our control, the consequences of which neither we nor our suppliers could avoid, examples of which are war or threat of war, riots, civil strife, terrorist activities, industrial disputes, natural or nuclear disaster, fire or adverse weather conditions, level of water in rivers or other similar events beyond our control.

8. Our responsibility

We recognise that adventurous activities have a danger of personal injury or death. Participants in these activities should be aware of and accept these risks and be responsible for their own actions. Other than as set out above, and as is detailed elsewhere in these conditions of booking, we shall have no legal liability whatsoever to you for any loss, damage, personal injury or death which you suffer arising directly or indirectly from any aspect of any activity arrangements booked with us.

8. Simply:

Adventurous activities may lead to personal injury or death. You accept these risks. Please be careful.

9. Simply:

We don’t take those aged under 18 years unless accompanied by a parent or legally appointed guardian.

9. Parental responsibility

Mountain Coach Ltd's Adventures are typically for members aged 18+. In the event that it has been agreed that young adults can join, then their parent(s) or legally appointed guardian undertakes to accept full responsibility for and supervision of their children at all times, especially in relation to Safeguarding.

10. Insurance

Adequate and valid travel insurance is compulsory for all our travellers and it is a condition of accepting your booking that you agree you will have obtained adequate and valid travel insurance. We recommend you take out insurance as soon as your booking is confirmed.

11. Complaints

We’ll try and deal with any complaint quickly and amicably.

If you have a complaint ahead of your final Alpine Adventure, please notify us via our contact details on this website. If you have a complaint during the final Alpine Adventure, you must notify our Guide immediately and they will do their best to resolve the problem. Should it not be possible to resolve your complaint there and then, you should write (email) us. This must be received no later than 28 days after your activity. All complaints that are received are thoroughly investigated and participants are kept informed. Sometimes investigations can take time, especially when awaiting a response from suppliers. We aim to settle all complaints amicably.
